नई दिल्ली। रिजर्व बैंक ऑफ इंडिया के साथ जारी मतभेदों के बीच मोदी सरकार ने आरबीआई के खिलाफ ब्रह्मास्त्र का इस्तेमाल कर दिया है। केंद्र सरकार ने आरबीआई ऐक्ट, 1934 के तहत मिले अधिकार का इतिहास में पहली बार इस्तेमाल किया है। इस कानून की धारा 7 के तहत सरकार को यह अधिकार प्राप्त है कि वह सार्वजनिक हित के मुद्दे पर आरबीआई को सीधे-सीधे निर्देश दे सकती है, जिसे आरबीआई मानने से इनकार नहीं कर सकता। अब आशंका जताई जाने लगी है कि सरकार और आरबीआई के बीच खटास बढ़ सकती है।सूत्रों से पता चला है कि रिजर्व बैंक ऑफ इंडिया ऐक्ट, 1934 के सेक्शन 7 के तहत सरकार को मिले अधिकार के तहत बीते एक-दो सप्ताह में आरबीआई गवर्नर को दो अलग-अलग पत्र भेजे जा चुके हैं। सरकार ने पत्र के जरिए केंद्रीय बैंक को नॉन-बैंकिंग फाइनैंशल कंपनियों के लिए , कमजोर बैंकों को पूंजी और लघु एवं मध्यम उद्योगों को कर्ज प्रदान करने का निर्देश दिया है। अनुमान लगाया जा रहा है कि सरकार के इसी प्रत्याशित कदम से आरबीआई के डेप्युटी-गवर्नर विरल आचार्य को नाराज हो गए और केंद्र सरकार को आरबीआई की स्वतंत्रता पर कुठाराघात करने के घातक परिणामों की चेतावनी + दे डाली। बहरहाल, आरबीआई के प्रवक्ता को ईमेल से भेजे गए सवाल पर कोई प्रतिक्रिया नहीं मिली है।रिजर्व बैंक ऑफ इंडिया ऐक्ट, 1934 की धारा 7 कहती है, केंद्र सरकार सार्वजनिक हित के लिए अनिवार्य मानते हुए बैंक के गवर्नर से मशविरे के बाद समय-समय पर इस तरह के निर्देश दे सकती है। सेक्शन 7 के तहत आरबीआई को निर्देश दिए जाने का मामला पहली बार तब आया जब कुछ बिजली उत्पादक कंपनियों ने आरबीआई के 12 फरवरी को जारी सर्कुलर को इलाहाबाद हाई कोर्ट में चुनौती दी। इस सर्कुलर में डिफॉल्ट हो चुके लोन को रीस्ट्रक्चरिंग स्कीम में डालने से रोका गया है। आरबीआई के सलहाकार ने जब बताया कि कानूनी तौर पर सरकार सेंट्रल बैंक को आदेश दे सकती है, तो कोर्ट ने अगस्त महीने में जारी अपने आदेश में कहा कि सरकार ऐसा निर्देश देने पर विचार कर सकती है। सरकार के इस आक्रमक रवैये से अकैडमिक्स और एक्सपर्ट्स का एक खेमा उत्तेजित होकर आरबीआई की स्वायत्तता को लेकर केंद्र सरकार की मंशा पर सवाल खड़े कर सकता है। दरअसल, सेक्शन 7 के इस्तेमाल के बाद केंद्रीय बैंक के पास अपनी मर्जी से फैसले करने की गुंजाइश बहुत कम रह जाती है। एक डर यह भी है कि अब आगे की सरकारें आरबीआई के साथ छोटे-छोटे मुद्दों पर भी मतभेद होने पर इस सेक्शन का इस्तेमाल करते हुए अपना अजेंडा थोपने लगेंगी।सरकार पावर सेक्टर में फंसे कर्जों (नॉन-परफॉर्मिंग ऐसेट्स यानी एनपीए) को लेकर तय नियमों में ढील चाहती है। मौजूदा नियमों के तहत लोन डिफॉल्ट पर कंपनियों को बैंकरप्ट्सी कोर्ट में घसीटने का प्रावधान है। एक बार कंपनियां इस कोर्ट में चली गईं तो उन्हें या तो बिकना पड़ता है या उसे बचाने के लिए सरकार को फंडिंग देनी पड़ती है। वहीं, प्रॉम्प्ट करेक्टिव ऐक्श यानी पीसीए को लेकर सरकार की चिंता यह है कि पीसीए के वर्गीकरण से सार्वजनिक क्षेत्र के 11 बैंकों और निजी क्षेत्र के एक बैंक पर कर्ज देने को लेकर कड़ी शर्त लगा दी। सरकार को लगता है कि इससे कुछ क्षेत्रों में फंडिंग का सूखा पड़ रहा है। सरकार एमएसएमईएस के भविष्य को लेकर भी चिंतित है, इसलिए चाहती है कि बैड लोन की परिभाषा को लचीला बनाया जाए।
